Chapter I. General Rules
Article 1. Based on existing related regulations of both the People's Bank of China(PBC) and China Foreign Exchange Trade System(CFETS), CFETS draws up the management rules to regulate the certification procedure and system access management standard of CFETS correlated system development organizations, ensure security of CFETS systems and reduce operational and system maintenance risk.
Article 2. The term “CFETS Correlated System Development Organizations (CCSDOs)” mentioned here refers to those development organizations authorized by CFETS and get engaged in the development of applications or systems correlated to CFETS systems.
Article 3. The term “CFETS technical services” mentioned here includes, but isnot limitedto, offering CFETS Application Program Interfaces(APIs), providing system access authority anduser acceptance testing services, offering related business or technical materials (including source code, technical documents ,data and other related information), and providing related technical support or consulting services.
Article 4. The term “The Interbank Market Participants (IMPs)” mentioned here refers toall institutions that havesystems interfaced with CFETS systems and carry out business on interbank markets.
Article 5. CCSDOs should meanwhile comply with other regulations ontechnical services and management stipulated or revised by CFETS.
Chapter II. Certification Management
Article 6. CFETS regulatesCCSDOs based on the certification management system. Organizations apply for the CCSDO certificate should:
a) be a qualified legal entity or a branch of an oversea legal entity, who gains operating license in China.
b) comply with related laws, regulations and industry standards, and have good reputation.
c) have goodtechnical and after-sales capabilities, and be able to offer qualifiedengineering, system maintenance and technical training services.
d) have at least 3years of development experience in financial related areas and have proved expertise in financial industry.
e) have registered capital over 5 million, development resources above 50 and possess at least one certificate in financial software development areas, project or quality management areas.
f) abide by other rules regulated by CFETS according to management demand and prudential standards.
Organizations that cannot meetcriteria (e) above should provide other certification materials recognized by CFETS or prove to have other outstanding advantages. CFETS will consider extending the limitation of criteria(e) accordingly.
Article 7. Organizations that meet the above preconditions can apply for CCSDO certificatevia providing the followingmaterials:
a) Completed application form of CCSDO Certification (See Appendix 1).
b) Certification materials, includingcopies of valid Business License, Organization Code Certificate and Tax Registration Certificate or other equalcertificates approved by CFETS.
c) Materials to prove technical and business capabilities, such as basic information of the organization, projects in recent 5 years, main project personnel, project management capability, customer services, maintenance and training services, certificatesgained and so on.
Application materials mentioned above should be affixedwith official seal.
Article 8. After receivingrequired materials, CFETS will review and verify the applicant’s comprehensive capabilities, reputation, project experience, expertise of its resources.
Article 9. Organizations thatpass the initial verification can arrange technical engineers to attend CCSDO certification training and evaluation process organized by CFETS. Technical engineerwho passes the evaluation can gain the Certificate of CCSDO Qualified Engineer issued by CFETS.
Article 10. Organizations with two or more CCSDO Qualified Engineers can proceed to sign framework agreement with CFETS and formallybe certificated as qualified CCSDO.
Article 11. When any of below occasions happened, the certificate of CCSDO Qualified Engineer will become invalid:
a) CCSDO makesa written application to quit its CCSDO Qualified Engineerdue tohis or her jobchange;
b) Absent twice in required CFETS training without reasonable ground;
c) Complained by IMPs and verified by CFETS;
d) Certificate gets expired and the certificate holder does notre-apply in 3 months;
e) Any other violations against CFETS related regulations and rules.
Article 12. Toregain the certificate of CCSDO Qualified Engineer, the technical engineershouldre-attend CCSDO certification training and evaluation.
Article 13. The Qualified CCSDO Certificate is not permanently valid. If any of below occasions exists, CFETS can request the CCSDO to rectify within a certain period of time or withdraw the Qualified CCSDO Certificate:
a) Fail to undertake related projects without reasonable ground in 2 years from gaining the certificate;
b) Thesystemdeveloped by the organization triggersproduction accident and results in significant impact on CFETS systems;
c) Fail to have a minimumof 2 CCSDO Qualified Engineers;
d) Fail to comply with rules listed in this regulation and the signed framework agreement;
e) Use thecertificate to seek illegitimate benefit;
f) Fail to pass CFETS annual evaluation and do not rectify as required;
g) Complained by IMPs and verified by CFETS;
h Any other violation against national laws and regulations, industry standard or CFETS related regulations and rules.
Article 14. Qualified CCSDO can request to quit via writtenapplication due to change of business scope, termination of business, or other occasions considered inappropriate of beinga Qualified CCSDO.
Article 15. To regainthe Qualified CCSDO Certificate, the organization willhave to undergo the certification process again.
Chapter III. Development Management
Article 16. Qualified CCSDO can apply usingCFETS Application Programming Interface (API). After agreed by CFETS, Qualified CCSDO should sign related API agreement and CFETS will provide required information for API development and environment configuration to the CCSDO.
Article 17. After completing development, Qualified CCSDO can request for acceptance testing in development environment arranged by CFETS. Passing the performance and reliability testing in development environment will be considered as a favorable reference when the organization undertakes similar API development for other IMPs.
Article 18. Qualified CCSDO can apply for access authority of related systems according to the requirement of system development. CFETS will provide the access authority after formal verification.
Article 19. Qualified CCSDO should perform the development and test following applicable technical standards, such as “Interbank Market Technical Standards of Client-end Trading System”, “Interbank Market API Usage Rules”and so on.
Chapter IV. Rights and Obligations
Article 20. Qualified CCSDO has below rights:
a) Qualified CCSDO can obtain API development related information, including business documents, technical materials and so on;
b) Qualified CCSDO can get higher leveltechnical support and consulting service, such as remote code diagnosis, onsite technical support, expert consultation and so on;
c) Qualified CCSDO can apply skipping the procedure of performance and liability test if the CCSDO already have their application program tested in development environment;
d) Qualified CCSDO can assign technical personnel to contact with CFETS for technical issues during the acceptance test;
e) Qualified CCSDO takes priority to attend technical seminar and various technical and business training in interbank market organized by CFETS;
f) Qualified CCSDO can get periodical information on CFETS technical and business new trend and have priority to attend the discussion on CFETS API development;
g) Qualified CCSDO or IMPs thatuse systems developed by Qualified CCSDO take priority to try new businesspromoted by CFETS;
h) Qualified CCSDO can enjoy favorable price for training, support and other services;
i) CFETS will publish outstanding Qualified CCSDO name list to IMPs.
Article 21. Qualified CCSDO should follow below obligations:
a) Qualified CCSDO should abide by related national laws and regulations, industry standards, and governance rules issued by PBC and other regulatory authorities, including but not limited to “Interbank Market Information Exchange Protocol”(JR/T 0066), “Interbank Market Metadata”(JR/T 0065) and other financial industry standards;
b) Qualified CCSDO should assign Qualified Engineers to attend technical and business training according to arrangement of CFETS. When undertaking development projects of CFETS correlated systems, Qualified CCSDO should ensure that at least one Qualified Engineer must participate in the project as project manager or chief architect. Qualified CCSDO should report any resignation or changes of CCSDO Qualified Engineer and arrange other employees to re-attend the certification.
c) Qualified CCSDO should actively cooperate with CFETS on API upgrade, system integration test and other related works. Whenclient-end systems of market participants encounter technical issues, Qualified CCSDO shouldactively cooperate with market participants to perform pre-test to exclude basic issues like internet failure, software and hardware configuration and application issues, and help solve client-end issues in time;
d) Qualified CCSDO should improve technical and business capabilities, standardize the process of system development and test to ensure system security, provide qualified and high efficient development, maintenance and training service to interbank market participants with reasonable price according to the development need of interbank market;
e) Qualified CCSDO should report annually to CFETS on existing situations of certificated engineers and CFETS correlated API development;
f) The validity period of the Certificate of CCSDO Qualified Engineer is 2 years. Qualified CCSDO should request for re-verification every 2years and reactivate the certificate after approved by CFETS;
g) Qualified CCSDO should report to CFETS in time when significant changes of business operation and organizational qualifications happen;
h) Qualified CCSDO should pay related fee in time for management, certification, technical services, training, conferences and so on.
Chapter V. Administration and Supervision
Article 22. Once CFETS interfaces and related documents change, CFETS should inform Qualified CCSDOs to update specific API version and related documents. CFETS can request all Qualified CCSDOs to attend related training when significant changeshappen.
Article 23. Without written authorizationfrom CFETS, Qualified CCSDOs cannot disclose related confidential information, such as documents on trading systems, interfaces and so on. Any violation will be held liable according to related laws.
Article 24. CFETS will perform annual evaluation based on the operation of online systems, development projects, interbank standard construction and participation, technical and business capability and training participation, and publish the name list of outstanding Qualified CCSDOs to IMPs.
Chapter VI. Supplementary Provisions
Article 25. This regulation only stipulates basic conditions and requirements for Qualified CCSDOs. Qualified CCSDOs should meantime abide by other rules issued by CFETS and regulatory authorities.
Article 26. CFETS performs the CCSDO certification and management prudently and objectivelybased on this regulation and can authorize other related organizations to carry out the certification and management. When offering technical services to IMPs, involved parties should agree on related rights, obligations and responsibilities. CFETS is not liable to ensure the technical services provided by Qualified CCSDOs.
Article 27. CFETS takes responsibility to explain and revise provisions stipulated in this regulation.
Article 28. Theregulations come into force from the date of release.
